LICENSE AGREEMENT
Standard License:-
By purchasing and downloading royalty free music from Webtones Music you or the named business (The Licensee) agrees to abide by the terms of this license:-
1) All royalty free music is licensed on a non-exclusive basis.
2) Copyright does not transfer to The Licensee. All rights remain the property of the copyright owner.
3) The license is non-transferable and is validated by proof of purchase. The Licensee cannot share, re-sell, reproduce or otherwise transfer the royalty free music to any other individual(s) or business.
4) The license lasts for 100 years from the date of purchase, and the territory is world wide.

The license grants mechanical & synchronization rights to use the royalty free music in an audio/visual context. The royalty free music must be in synchronization with other audio and/or visual effects.
6) The Licensee may only duplicate the royalty free music for the purposes of allowing synchronization (see 5 above), or for archiving/achieving compatibility with licensee's production equipment.
7) You may edit our royalty free music (fade, crop, cut, stretch, loop) etc. to fit your project.
8) This license does not include performance rights. When music from Webtones Music is to be performed publicly including but not limited to television & radio broadcasts, the composer names and track details (title, duration, etc.) must be given to the broadcaster to forward to the relevant national Performance Rights organization. (This is usually via 'cue sheets' from ASCAP, BMI in USA, or PRS in UK for example). This is so that money already paid by the broadcaster can be allocated to the composers, otherwise the Performance Rights organization retains it. As a production company this costs The Licensee nothing. Check with your local Performance Rights organization for their regional policies on other public performances. Each piece of royalty free music in our library has the composers name and Performance Rights organization they belong to listed and this information also appears on the customer generated Royalty Free Music License Receipt.
8.1) UK On-line Usage:
As of spring 2008, the PRS (Performance Rights Society) in the UK now collects broadcasting fees from UK companies using music on-line. This means that even if you buy a license from us, you also need to buy an Online License from the PRS in order to use music on your site. This applies to all music composed by any composer who is a member of any performance rights society world wide, which includes most of our composers. The PRS Online license typically costs £50 per year. You can obtain this license directly from the PRS website:-

This only applies to persons or businesses in the United Kingdom using music on UK web sites. If you would like to avoid paying this additional fee to the PRS then you can, simply by selecting music composed by a composer not affiliated with any Performance Rights organization.
9) When synchronizing the royalty free music within a physical product such as a video, dvd, CD-ROM CD or a software product such as a downloadable video game, production runs/downloads may not exceed 5000. Production runs/downloads exceeding 5000 will require a Mass Production License payable separately.
10) Theatrical use is not included in our standard license. To use our royalty free music in a "Theatrical Release" (commercially released film or theater production, general public viewing where a fee is collected), you will require a Theatrical Release License payable separately.
11) With respect to any royalty free music available from Webtones Music, neither Webtones Music nor any of its employees, makes any warranty, express or implied, including the warranties of merchantability and fitness for a particular purpose, or assumes any legal liability or responsibility for the accuracy, completeness, or usefulness of any information, apparatus, product, or process disclosed, or represents that its use would not infringe privately owned rights.Webtones Music's liability shall in no event exceed the actual price paid by The Licensee for the license.
Mass Production License:-
Our standard license gives you the right to reproduce up to 5,000 copies of a product containing our royalty free music. To reproduce and/or sell more than 5,000 copies of a product that contains our royalty free music, for sale or promotion, you need a mass production license. Mass production license fees are in addition to the standard license fee. To order a Mass Production License please contact us indicating which royalty free music you require a license for. We will request the additional mass production license fee via PayPal, on receipt of payment a relevant Mass Production License will be issued to you by email.
Prices are based on copies produced:-
Up to 10,000 copies - an additional $25.00 fee per track is required.
Up to 50,000 copies - an additional $75.00 fee per track is required.
Up to 100,000 copies - an additional $115.00 fee per track is required.
Up to 500,000 copies - an additional $145.00 fee per track is required.
Up to 1 million copies - an additional $175.00 fee per track is required.
Up to 2 million copies - an additional $255.00 fee per track is required.
Unlimited copies - an additional $295.00 fee per track is required.
Theatrical Release License:-
To use our royalty free music in a Theatrical Release (commercially released film or theatre production, general public viewing where a fee is collected), you need a Theatrical Release License at US $295.00 per track. To order a Theatrical Release License please contact us indicating which royalty free music you require a license for. We will request the additional theatrical release license fee via PayPal, on receipt of payment a Theatrical Release License will be made out to you, and will include the name of your production.
